This is the least common order we receive.
This is the correct form to use if you have a divorce involving children, and one of the following is true:
1.) “My spouse may or may not sign papers, but I know where they are at, and we can get them served. I don’t expect my spouse to cooperate or to fight me about anything. They’ll get the papers and they won’t fight back or agree.”
2.) “My spouse will sign papers, but we want to save $274 and get a default divorce instead of a consent divorce. I realize I will have to go to a hearing to finalize the divorce; I realize the judge will have final say on our parenting schedule.”
